At the request of the Association of Land Companies, Thomas ten Berge and Gijs van Midden wrote an article on the consequences of grid congestion in area development practice. In the article, the authors explore both the consequences for practice and the public and private law options for dealing with the consequences of grid congestion issues. Among other things, they pay attention to the grid operator's liability, instruments from the Environment Act, and future legislation strengthening public governance of energy transition.
